GENERAL TERMS AND CONDITIONS PORIVERTRAVEL.IT
CONTRACT OF JOURNEY AND LIABILITY
The present contract is part and parcel of the journey/cruise service bought by the client, attested by the signature for acceptance. The confirmation and the payment of the deposit from the client is considered acceptance of the present contract. All personal data are processed and treated in compliance with the law Privacy of the Unique Text Government Decree n°196 of 30.06.2003.
JOURNEY/CRUISE
The contracts of journey are regulated by the ratification and execution Act n°1084 of 27.12.1977 of the International Convention concerning the contract of journey (CCV) signed in Brussels on 23.04.1970 and by the Government Decree n°111 of 17.03.1995. The tour operator/travel agency liability cannot in any case exceed the limits fixed by the mentioned laws.
PAYMENT OF THE CONTRACT OF JOURNEY
We accept written booking and we consider them confirmed on receipt of the earnest equal to the 25% of the total amount of the journey’s price. If the booking occur within 25 days before the departure date we require the complete payment of the journey/cruise’s total amount.
The deposit will be detained as penalty in case of non- communicated cancellation from the client within 60 days before the departure date. The settlement must be paid within 30 days before the departure date.
The payments of the deposit, the price for the dossier opening and of the settlement must be paid by bank transfer or money order within the specified terms. The non-payment of these sums on the fixed dates constitutes a clause of defeasance indicated in the contract, that determines the resolution of this latter, unless the client will refund the organiser for the suffered damages.
It is very important to specify the name of the group leader or of the firm/body, the date and the name of the selected itinerary and/or cruising, the tax code, the telephone number and the mobile phone reference number. It is necessary to send by fax n° 0522.739019 a copy of the bank transfer with the CRO and SWIFFT number indicated and/or the money order. You must send name and surname, the address, the tax code of every participant, and the mobile phone number of the group leader, active during the journey/cruise. After the payment of the settlement we will send you the voucher with the details of the purchased services , that you must show at the meeting with the group and/or at the embarkation or at the office of the purchased services.
If you cannot show the voucher, you can show the receipt of the deposit or settlement payment; otherwise we will debit you the total amount of the trip.

CHANGES
If the client requires some changes after the journey/cruise/service purchase, attested by the deposit payment, the organizer will debit the relative costs starting from € 50,00 + VAT.
If the main part of the services mentioned in the contract of journey cannot be executed after the client departure, the organizer will arrange suitable alternative solutions without any additional charge for the traveller. Alternatively he/she will refund the traveller for the difference between the paid services and the executed services, except for the indemnity of the possible damage proved by the traveller.
CANCELLATION COST AND REFUNDS
In case of renunciation of the journey/cruise package the following penalty will be applied:
If the traveller will cancel the organized journey/cruise package, the following penalty will be imposed on the journey/cruise price, that is entrance fee net, according to the following cancellation penalties and terms, plus further possible costs due to the service cost rise:
- 50% of the journey price until 15 days before the departure date
- 75% of the journey price until 5 day before the departure date
- 100% of the journey price after these terms
The organisation assumes no responsibility for possible lacks or inconveniences to people due to the ticket office administration and during the visit at monuments and/or exhibitions and/or other sites not due to the organization. Cancellations for all or any part of the trip will not be effective until they are received in writing in the office of PORIVERTRAVEL.IT.
In addition, any applicable cancellation fee of services concerning the journey/cruise programme and the administrative fee will be assessed.

LUGGAGE
The luggage travels at client’s risk and possible losses or damages are not responsibility of the Travel Agency PORIVERTRAVEL.IT.
BOOKING CONDITIONS
The obligatory bookings can be effected personally by written, telefax or e-mail confirmation. When booking, the client has to pay a deposit equal to the 25% of the total amount; the settlement is due 30 days before the departure date and all the booked place have to be paid. The client must send a list of the participants with name, surname, date of birth and residence land and the group leader’s data and a tax code photocopy.
The booking acceptance depend on the place availability and the booking has worth after the receipt of the written confirmation and the deposit. The PORIVERTRAVEL.IT Travel Agency can cancel the contract without indemnity if the minimum number of travellers set out in the programme is not reached.
CANCELLATION AND CHANGE CRUISES
As public service, obligatory bookings can be effected personally by written, telefax or e-mail confirmation.

When booking, the client has to pay a deposit equal to the 30% of the total amount, that will be kept as penalty in case of non-communicated renunciation from the client within 60 days before the departure date; the settlement is due 30 days before the embarkation date and all the booked places have to be paid.
The booking acceptance depend on the place availability and the booking has worth after the receipt of the written confirmation and the deposit. The “cruising company” can cancel the contract without indemnity if the minimum number of travellers set out in the programme is not reached. Seats aboard are unnumbered. Animals are admitted only if in cage; the client can transport only small luggage such as hand luggage.The “cruise company” is not responsible for personal belongings left aboard during stops.
CANCELLATION
In case of ships non-departure, due to technical reasons such as average, adverse hydrometrical conditions of rivers or for “force majeure”, the “cruising company” can cancel bookings putting them off in other date fixed in accordance with the clients; alternatively the “cruising company” will refund the excursion cost already paid. The “cruising company” assumes no responsibility for the unexpected closing of villas, churches or sites mentioned on the programme, as well as for delays or journey suspension due to the basins or bridges opening depending on the public administration or unexpected cruising suspension order.
CANCELLATION POLICY/CRUISE CANCELLATION COST CHARGED TO THE CLIENT
In case of renunciation of the journey/cruise package the following penalty will be applied:
- no penalty for cancellation until 60 days before the group arrival date;
- 30% of the total amount until 30 days before the group arrival date;
- 50% of the total amount until 20 days before the group arrival date;
- 100% of the journey price after these terms;
- The total amount after these terms or in case of non-show.
GUARANTEES
All passengers aboard of the “cruising company” motor ship are insured, in compliance with the law, against every journey risk.
The “cruising company” reserves the possibility to cancel bookings, even without notice, for “force majeure” or for unquestionable decision of the ship’s captain, as for example in the following cases: average, adverse hydrometrical conditions of rivers, industrial dispute by the crew or the ground crew, any other reason that may jeopardize the safety of navigation, cruising suspension order. In these cases the company will only refund the amount paid for the booking.
VARIATIONS
According to the unquestionable decision of the ship’s captain, the selected itineraries can vary, also in the duration, because of particular environmental conditions or situations occurred during the navigation. The motor ship is in order with the prescribe safety dotation for the internal navigation and insurance.
INFORMATIVE FOR THE PROTECTION OF PERSONAL DATA

Dear Client, we wish to inform you that your personal data will be processed from PORIVERTRAVEL.IT in compliance with the fundamental principles of correctness, transparency and confidence protection, set out in the Government Decree n°196 of 30/06/2003 “Law for the protection of personal data”.
1. PURPOSE AND FORMALITY OF THE DATA PROCESSING
The processing of your personal data will occur either by hand or by means of suitable electronic systems with logic and modality related to the working activity.
Data will be processed in compliance with the confidence and security rules provided for the law, even in case of communication to thirds; the collected data will be kept and processed for a period of time necessary to the fulfilment of the required or purchased service connected to the marketing, promotional, administrative and accounting (including the invoice transmission) activity of PORIVERTRAVEL.IT.
2. VOLONTARY NATURE OF THE DATA CONFERMENT AND CONSEQUENCES OF A POSSIBLE NON-ANSWER.
Your personal data have voluntary nature in order to execute operations mentioned in the point 1).
The non-indication of parts of these and/or the consequent non-authorization to use the data involves our impossibility to supply the services here over.
Your data may be communicated to our processing responsible, set out in the Security Programmatic Document, and to external subject needed for the fulfilment of the supplied services.
3. RIGHTS OF THE INVOLVED PARTY
The article n°7 of the Government Decree 196/03 grant you, as subject involved, the following rights:
- to obtain the confirmation of the existence of your personal data, even if they are not still registered, and their communication by intelligible form.
- to obtain information related to the personal data origin, the purpose and the modality of their processing, of the applied logic in case of processing with electronic means, the identificatory main points of the proprietor, the person in charge and the subjects or subject group to which data may be communicated in one’s capacity as people in charge.
- to obtain the data updating, adjustment or the integration, their cancellation, the modification in anonymous form or the block of data processed breaching the law, the attestation that these operations are transmitted to possible subjects which data are communicated or divulgated.
- to oppose to the processing of your data in the case of right reasons or in the case of these data are used to send advertising or direct marketing material or for market researches.

5. EXPRESSION ON THE AGREEMENT
I acquired the informative, of which at the article 7 of the Government Agreement 196/03, and I express my agreement for the processing of my personal data and I authorize their communication and divulgation.

During the service execution, it is not allowed to use narcotic and alcohol and to organize parties and particularly provocative circumstances.
Obligatory communication according to the article 16 of the act 3.08.1998 n°269 – the Italian law punishes with the detention crimes related to prostitution and juvenile pornography, according to the article 6 of the Government Decree n°111/1995.

Any dispute concerning this contract shall be dealt exclusively by the International and National Arbitral Court where is the head office of the Cruising Company and the Court of Reggio Emilia for PORIVERTRAVEL.IT.
